Chapter 9.5. Supplemental Caterers' Permits

Application
Sec. 1. Application. The commission may issue a supplementalcaterer's permit only to a person who is, and continues to be, theholder of a three-way permit and who desires to sell, on a temporarybasis only, alcoholic beverages for on premise consumption atlocations other than his licensed premises.

Notices
Sec. 2. (a) The holder of a supplemental caterer's permit shallnotify the commission in writing fifteen (15) days in advance of eachfunction that the permittee intends to cater with alcoholic beverages.The commission may waive the fifteen (15) day notice periodrequired under this subsection, but may not waive the requirementfor filing notice.
(b) The notice shall include the following:
(1) The date, time, and location of the function to be catered.
(2) If the function is open to the public, located in a countyhaving a population of less than one hundred fifty thousand(150,000), and located in a different county from the countywhere the permittee holds the three-way permit required undersection 1 of this chapter, the signature of the following officialon a document stating the official's approval of the catering ofalcoholic beverages at the proposed date, time, and location:
(A) The president of the town council, if the location is in atown.
(B) The mayor, if the location is in a city.
(C) The president of the board of county commissioners, ifthe location is in unincorporated territory.
(c) If a permittee complies with all notice requirements ofsubsection (b), the commission in its absolute discretion has theauthority, any other provision of this title to the contrarynotwithstanding, to approve the proposed date and location of thefunction to be catered.
(d) The commission need not notify the permittee if thecommission approved the proposed date and location, and thepermittee may proceed as stated in the permittee's notice to thecommission. The commission shall notify the permittee by certifiedUnited States mail, in advance of the function, if the commissiondoes not approve the proposed date or location.
(e) A permittee whose proposed date or location has beendisapproved by the commission still may cater the function on thatdate and at that location, but the permittee may not cater alcoholicbeverages at that function on that date and at that location.

Scope of permit
Sec. 3. Scope of Permit. The holder of a supplemental caterer'spermit is entitled to purchase alcoholic beverages only from apermittee entitled to sell to him under this title. The holder of asupplemental caterer's permit is entitled to sell alcoholic beveragesonly for on premise consumption at those locations approved by thecommission and at times lawful under his retailers' permits. Theholder of a supplemental caterer's permit is not entitled to sellalcoholic beverages at wholesale, nor for carry-out or at-homedelivery.

Nature of permit
Sec. 4. Nature of Permit. A supplemental caterer's permit, for thepurposes of this title, shall be considered a separate and distinct typeof retailer's permit. It shall not affect the rights, privileges, andrestrictions applicable to any other type of retailer's permit. Therights, privileges, and restrictions provided in this title for asupplemental caterer's permit apply only to this type of permit.
