Transfer of authority to supply piped drinking water to personother than city or town; time of test; rules
    
Sec. 1. Within thirty (30) days before the date that the authorityto supply piped drinking water is transferred from a city or town toa person other than a city or town, the state department of healthshall conduct a test to determine the quality of the drinking watersupplied by the city or town. The state department of health shalladopt rules under IC 4-22-2 concerning the test that is required underthis section.

Minimum quality of water
    
Sec. 2. After August 31, 1981, if the authority to supply pipeddrinking water is transferred from a city or town to a person otherthan a city or town, the piped drinking water must, at the time oftransfer, be at least equal in quality to the water tested under section1 of this chapter which was supplied by the city or town. A personshall comply with this section within ten (10) days of the date onwhich it is found by the state department of health that the personsupplies drinking water that does not comply with this section.

Maintenance of quality
    
Sec. 3. A person, other than a city or town, to whom the authorityto supply piped drinking water is transferred from a city or town,shall maintain, to the extent practicable and reasonable, the qualityof water required at the time of transfer of such authority, undersection 2 of this chapter.

Violations
    
Sec. 4. A person who supplies drinking water that does notcomply with section 2 of this chapter commits a Class B infractionfor each day he is in violation.
