Chapter 3. Ports of Indiana.Foreign Trade Zone and In-TransitStorage

Authority for acquisition and operation of port facilities
Sec. 1. (a) Except as otherwise provided by this chapter, thedefinitions set forth in IC 8-10-1-2 apply throughout this chapter.
(b) In addition to the powers conferred upon the ports of Indianaby other provisions of this article, the ports of Indiana shall have thepower whenever the ports of Indiana finds it either desirable ornecessary in order to increase the water borne traffic into or out ofthe port to acquire, lease, construct, maintain, repair, and policefacilities, adjuncts, and appurtenances for use in the business of intransit processing, finishing, reduction, conversion, completion,packaging, bottling, transshipment, or handling of commodities. Inexercising the powers granted in this section, the ports of Indianashall have all the powers granted to the ports of Indiana by thisarticle in connection with a port project, and the term "port project",as used in this article, shall be deemed and construed to includefacilities, adjuncts, and appurtenances of the character referred to inthis section.

Authority for establishment and operation of foreign-trade zones
Sec. 2. The ports of Indiana, or a public or private agency orcorporation of the state of Indiana designated by the ports of Indiana,is hereby authorized to make application to the board established bythe act of Congress approved June 18, 1934 (48 Stat. 998-1003; 19United States Code 81a-81u) (Public Law 397, 73rd Congress)entitled "an act to provide for the establishment, operation, andmaintenance of foreign-trade zones in ports of entry of the UnitedStates to expedite and encourage foreign commerce and otherpurposes," and all acts amendatory thereto, for a grant to the ports ofIndiana, or a public or private agency or corporation of the state ofIndiana designated by the ports of Indiana, of the privilege ofestablishing, operating, and maintaining a foreign-trade zone at suchplaces within the state of Indiana as the ports of Indiana maydetermine, including lake ports, river ports, and elsewhere, pursuantto the provisions of such act, and if such application be granted toaccept such grant and to establish, operate, and maintain such zonein accordance with law.

Eminent domain
Sec. 3. The ports of Indiana in any appropriation of property,
under the provisions of the appropriate eminent domain law, maytake either a fee simple title in any property, or easement, orright-of-way, or riparian right, or any other estate therein as in anyparticular instance as to any parcel of property may be deemednecessary by the ports of Indiana.
