    Chapter 11. Local Bridge Grant Fund

"Board" defined
    
Sec. 1. As used in this chapter, "board" refers to the local bridgegrant board established by section 9 of this chapter.

"Local bridge" defined
    
Sec. 6. As used in this chapter, "local bridge" means a structurethat:
        (1) is designed to carry vehicular traffic over or under anobstacle to the normal flow of traffic, including any gradeseparation, culvert, or approach to a bridge; and
        (2) is located on a public road in a county highway system thatis not part of the federally aided highway system.

"Reconstruction" defined
    
Sec. 7. As used in this chapter, "reconstruction" includes theresurfacing and rebuilding of a local bridge to the extent that

significant structural improvements result.

Establishment of fund; administration
    
Sec. 8. (a) The local bridge grant fund is established to:
        (1) provide grants to counties for the construction andreconstruction of local bridges; and
        (2) pay the costs of administering this chapter.
The fund shall be administered by the department.
    (b) The treasurer of state shall invest the money in the fund notcurrently needed to meet the obligations of the fund in the samemanner as other public funds may be invested. Interest that accruesfrom these investments shall be deposited in the fund.
    (c) Money in the fund at the end of a fiscal year does not revert tothe state general fund.

Board; establishment; members; tenure; compensation; quorum
    
Sec. 9. (a) The local bridge grant board is established to receiveand review applications for grants under this chapter. The boardconsists of the following members:
        (1) The director of the department, or the director's designee.
        (2) Six (6) persons appointed by the governor, no more thanthree (3) of whom may be of the same political party, asfollows:
            (A) Two (2) members of a county executive.
            (B) One (1) county highway engineer.
            (C) One (1) mayor of a city.
            (D) One (1) member of a town board of trustees.
            (E) One (1) person with substantial experience or educationin the design or construction of bridges.
        A member appointed under clause (A), (B), (C), or (D) whoceases to hold the office described in that clause ceases to be amember of the board.
    (b) The governor shall designate a member of the board to serveas chairman.
    (c) Members of the board who are appointed by the governorserve for terms of four (4) years. The governor shall fill a vacancy onthe board by appointing a new member to serve the remainder of theunexpired term.
    (d) A member of the board, other than the director of thedepartment, is entitled to the minimum salary per diem provided byIC 4-10-11-2.1(b). Each member of the board is entitled toreimbursement for traveling expenses and other expenses actuallyincurred in connection with the member's duties, as provided in thestate travel policies and procedures established by the department ofadministration and approved by the budget agency.
    (e) Four (4) members of the board constitute a quorum. The

affirmative votes of four (4) members of the board are required forthe board to take any action.

Board support staff
    
Sec. 10. The department shall provide staff support to the board.

Grant application evaluation criteria
    
Sec. 11. The board shall establish criteria to be used in evaluatingapplications for grants from the fund. These criteria:
        (1) must be consistent with the purposes of the federal localbridge program (23 U.S.C. 144(n));
        (2) must be based on good engineering practices; and
        (3) must provide for an equitable distribution of grants tocounties located throughout Indiana.

Grant application; requirements
    
Sec. 12. (a) The executive of a county may apply to the board fora grant from the fund to be used to pay up to eighty percent (80%) ofthe cost of construction or reconstruction of one (1) or more localbridges. At the time of the application, the county executive shallnotify the department of local government finance that the county hasmade the application.
    (b) The application must include the following:
        (1) A description of the construction or reconstruction projectsfor which the grant application is made.
        (2) The estimated cost of the projects.
        (3) The amount of funding the county will provide for theprojects, which must be at least twenty percent (20%) of theestimated cost of the projects. This amount may include thevalue of labor and materials to be provided by the county.
        (4) Any other information that the board or the departmentconsiders necessary.

Grant application financial report
    
Sec. 13. Within thirty (30) days after a county applies for a grantunder section 12 of this chapter, the department of local governmentfinance shall submit to the department a financial report that includesthe following information:
        (1) The amount of money available to the county for theconstruction and reconstruction of local bridges.
        (2) Any other information required by the board or the

department for the processing of grant applications.

Evaluation of grant application; approval; notice
    
Sec. 14. The board shall use the criteria established under section11 of this chapter and the report submitted under section 13 of thischapter to evaluate an application for a grant from the fund. Theboard shall notify a county that makes a grant application of theboard's approval or disapproval of the application within sixty (60)days of the date of the application. The board's decision to approveor disapprove a grant application is final.

Agreement; terms
    
Sec. 15. The board and each county for which a grant has beenapproved under this chapter shall enter into an agreement specifyingthe purposes for which the grant may be used. The terms of theagreement must be consistent with the purposes of this chapter.
