Chapter 6. Appropriation of Dedicated Highway Funds

Budget estimates
Sec. 1. Where, by virtue of the provisions of any law of this state,any designated portion of the gasoline tax collected by the state shallhave been distributed to the several cities of the state to be used forthe maintenance and repair of the streets of such cities, such fundsshall be under the exclusive control of the common council, and shallbe used and expended by, the board of public works of any such city,or the common council thereof, acting as the board of public works.The maintenance and repair of streets, for which any such funds maybe used and expended, shall be deemed to include any part of thecost of resurfacing, widening or reconstructing any street or any partthereof which any such city may be liable to pay pursuant to any lawauthorizing the improvement of streets; Provided, That any suchfunds so distributed hereafter shall be estimated and included in thepublished budgets of such municipalities in the year preceding suchdistribution.
