    Chapter 3. Petition for Public Highway Improvement

Plans and specifications for improvements
    
Sec. 1. Ten (10) or more resident freeholders may petition thecounty executive for assistance in grading any public highwayconnecting at either end with a county or state highway, connectingwith any highway improved under this chapter, or connecting withthe boundaries of any municipality. If the executive determines thatit would be a public utility to grade and drain the highway, theexecutive shall order the engineer to survey the highway and prepareplans and specifications for its improvement. The plans andspecifications must show:
        (1) the profile, grade, and cross-section of the old and newroadway at least at each one hundred (100) feet, that theroadway shall be graded to a width of twenty (20) feet betweenthe inside of ditches (except where physical conditions makethat width impossible) and that the roadway shall have across-section crown of eight (8) inches, and a grade not toexceed six percent (6%);
        (2) the design of any necessary supplemental road parts; and
        (3) the method of grading and finishing the roadway.

Improvements in accord with plans and specifications
    
Sec. 2. After establishment of grades and receipt of the plans andspecifications from the engineer, the petitioners, at their ownexpense, and under the direction of the engineer, shall improve theroad according to plans and specifications.

Report of completion
    
Sec. 4. When the grading and draining is completed in accordancewith the plans and specifications, the engineer shall report in writingto the county executive, who shall accept the improved highway.After acceptance, the highway shall be maintained by the county.
