Chapter 4. Petition for Unimproved Public Highway Improvement

Employment of engineer; plans and specifications
Sec. 1. One (1) or more taxpayers of any county, may petition theexecutive of the county for permission (at the petitioner's ownexpense) to improve, by grading, draining, and paving with roadpaving material, any unimproved public highway in the county. If theexecutive determines that it will be of public utility to the county toimprove the highway, the executive shall employ a competentengineer, to be paid by the petitioner to survey and mark theboundaries of the highway, prepare plans, and specifications (inaccordance with requirements of the county) for the improvement ofthe highway, and to file the survey, plans, and specifications with theexecutive for examination and approval.

Approval and construction
Sec. 2. After approval, the petitioners, at their own expense andunder the direction of the county highway supervisor, shall improvethe highway according to the plans, specifications, and survey.

Report of completion
Sec. 3. When the grading, draining, and paving is completed, thecounty highway supervisor shall report in writing to the countyexecutive. The executive shall then accept the improved highway.
