Chapter 5. Local Participation in Interstate Airports

Interstate airport facilities; approval
Sec. 1. The governing body of a county, city, village, town, orother political subdivision of an adjoining state whose statutes permitmay acquire, establish, construct, own, control, lease, equip,improve, maintain, and operate airports, landing fields, or other airnavigation facilities in Indiana, subject to statutes, rules, andregulations of Indiana applicable to its political subdivisions inaeronautical projects, but subject to the laws of the adjoining state inmatters relating to financing the projects. The aeronauticscommission of Indiana must approve the acquisition andestablishment of the airports, landing fields, or other air navigationfacilities before commencement of proceedings for acquisition orestablishment.

Rights of political subdivisions of adjoining state
Sec. 2. The political subdivision of an adjoining state has all therights, privileges, and duties of political subdivisions of Indiana,including the power of eminent domain, which must be exercised inaccordance with Indiana law, as to property not devoted to publicuse, and the power jointly with political subdivisions of Indiana toacquire, establish, construct, own, control, lease, equip, improve,maintain, and operate airports, landing fields, or other air navigationfacilities.

Powers of political subdivisions of state in air navigation facilitiesof adjoining state
Sec. 3. The governing body of any political subdivision of Indianamay acquire, establish, construct, own, control, lease, equip,improve, maintain, and operate airports, landing fields, or other airnavigation facilities in an adjoining state if the statutes of theadjoining state permit that action, subject to statutes, rules, andregulations of the adjoining state applicable to its own politicalsubdivisions in aeronautical projects, but subject to Indiana law inmatters relating to the financing of such projects. The aeronauticscommission of Indiana must approve the acquisition andestablishment of an airport or landing field in an adjoining statebefore the acquisition or establishment.

Reciprocity
Sec. 4. This chapter does not apply unless the statutes of the
adjoining state permit political subdivisions of Indiana to acquire,establish, construct, own, control, lease, equip, improve, maintain,operate, and otherwise control airports, landing fields, or other airnavigation facilities in that state, with all privileges, rights, andduties applicable to the political subdivisions of the adjoining statein aeronautical projects, including all tax privileges and immunities,the power of eminent domain as to property not devoted to publicuse, and the power jointly with political subdivisions of adjoiningstates to acquire, establish, construct, own, control, lease, equip,improve, maintain and operate airports, landing fields, or other airnavigation facilities.
