    Chapter 14. Rental of Highway Equipment

Rates
    Sec. 1. The department is prohibited from renting equipment forits use when the total cost of the proposed rental over the anticipatedperiod of use of the equipment exceeds the original cost of theequipment to be rented. The rent to be paid by the department shallnot exceed the figures listed in the most recent issue of "Compilationof Rental Rates for Construction Equipment" as prepared anddistributed by the Associated Equipment Distributors. This sectiondoes not preclude the department from renting equipment fullyoperated or from agreeing to pay the operators of the equipmentrented and agreeing to pay for the gasoline, fuel oil, or repairs duringthe rental period, in addition to the rent for the use of any equipment.

Emergency procedure
    Sec. 2. In case of an emergency, if it is impossible for thedepartment to procure the necessary equipment by rental undersection 1 of this chapter, the department may rent equipment subjectto the approval of the budget committee.
