Chapter 27. Illiana Expressway

"Committee"
Sec. 1. As used in this chapter, "committee" refers to the Illianaexpressway proposal review committee established by section 4 ofthis chapter.

"Illiana expressway"
Sec. 2. As used in this chapter, "Illiana expressway" refers to anew interstate quality highway connecting Interstate Highway 57 inIllinois to Interstate Highway 65 in Indiana.

"Study"
Sec. 3. As used in this chapter, "study" refers to the studydescribed in section 14 of this chapter.

Committee established
Sec. 4. The Illiana expressway proposal review committee isestablished.

Membership of committee
Sec. 5. (a) The committee consists of eight (8) voting membersappointed as follows:
(1) Four (4) members of the senate, not more than two (2) ofwhom may be from the same political party, to be appointed bythe president pro tempore of the senate.
(2) Four (4) members of the house of representatives, not morethan two (2) of whom may be from the same political party, tobe appointed by the speaker of the house of representatives.
(b) At least two (2) of the members appointed under subsection(a)(1) and at least two (2) of the members appointed undersubsection (a)(2) must represent a district that encompasses all orpart of Lake County.
(c) A vacancy on the committee shall be filled by the appointingauthority.
(d) Initial appointments to the committee must be made beforeJuly 1, 2007.

IC 8-23-27-6 Appointment of chairperson
Sec. 6. (a) The president pro tempore of the senate shall appointa member of the committee to serve as chairperson of the committeefrom January 1 through December 31 of odd-numbered years.
(b) The speaker of the house of representatives shall appoint amember of the committee to serve as chairperson of the committeefrom January 1 through December 31 of even-numbered years.

Duties of committee
Sec. 7. The committee shall do the following:
(1) Take and review the study presented to the committee undersection 14 of this chapter, testimony, and other informationprovided to the committee by the Indiana department oftransportation, other state agencies or federal agencies, and thepublic concerning the proposed Illiana expressway project.
(2) Prepare a report to be submitted to the governor and to thelegislative council in an electronic format under IC 5-14-6regarding the committee's determination of whether theproposed Illiana expressway project is recommended by thecommittee.

Meetings at call of chairperson
Sec. 8. The committee shall meet at the call of the chairperson.

Operating policies
Sec. 9. (a) Except as provided in subsection (b), the committeeshall operate under the policies governing study committees adoptedby the legislative council, including the requirement of filing anannual report in an electronic format under IC 5-14-6.
(b) The committee may meet at any time during the calendar year.

Quorum; votes required to take action
Sec. 10. (a) Five (5) members of the committee constitute aquorum.
(b) The affirmative votes of a majority of the voting membersappointed to the committee are required for the committee to takeaction on any measure.

Staff support
Sec. 11. The legislative services agency shall provide staff support
for the committee.

Compensation; expenses
Sec. 12. Each member of the committee appointed under thischapter is entitled to receive the same per diem, mileage, and travelallowances paid to members of the general assembly serving onlegislative study committees established by the legislative council.

Testimony by department
Sec. 13. Representatives of the Indiana department oftransportation shall testify before the committee upon request of thechairperson.

Study by department
Sec. 14. The department shall conduct an independent study to:
(1) perform a needs assessment of an Illiana expressway; and
(2) identify a highway alignment corridor for an Illianaexpressway.
The department may use any part of a study conducted before April29, 2007, to comply with this section.

Report by department
Sec. 15. (a) Before July 1, 2009, the department shall present areport to:
(1) the members of the committee in an electronic format underIC 5-14-6; and
(2) the governor;
that presents the findings of the study conducted under section 14 ofthis chapter and includes sufficient background for the members ofthe committee and the governor to evaluate the findings presented inthe study.
(b) The report required by subsection (a) must include at least thefollowing:
(1) A description of the need for an Illiana expressway.
(2) An evaluation concerning the feasibility of an Illianaexpressway, including the following:
(A) Projections for acquisition costs and eminent domainissues.
(B) Expected use of the proposed expressway and any tollrevenues.
(C) Expected construction costs.
(D) Expected operating and maintenance costs. (E) Options for funding acquisition, construction, operation,and maintenance costs.
(3) A description of the department's recommended route for anIlliana expressway, including the following:
(A) Traffic projections showing expected use and relief oftraffic congestion.
(B) Alternative routes.
(C) Economic impact studies on the proposed route andaffected areas.
(4) Any other information that is necessary or appropriate toassist the general assembly in evaluating the Illiana expresswayproject.

Sources of payment for study
Sec. 16. The department may pay for the study conducted undersection 14 of this chapter from any funds available to the department.The amount expended for the study may not exceed one milliondollars ($1,000,000).
