Commuter rail service board
    
Sec. 1. The board of trustees of the northern Indiana commutertransportation district is the service board for the commuter raildivision.

Sec. 2. IC 8-5-15 applies to the membership, powers, andoperation of the commuter rail service board.

Powers
    
Sec. 3. Subject to this article, the board of trustees of the northernIndiana commuter transportation district has the following powers:
        (1) The powers granted by IC 8-5-15 or any other law to theboard of trustees of a commuter transportation districtestablished under IC 8-5-15.
        (2) The powers granted to a commuter rail service board underthis article.

Commuter rail division; powers
    
Sec. 4. The commuter rail division shall operate under the namenorthern Indiana commuter rail district and has the following powers:
        (1) The powers granted by IC 8-5-15 or any other law to acommuter transportation district established under IC 8-5-15.
        (2) The powers granted to a commuter rail service divisionunder this article.

Commuter rail service advisory board established; membership;meetings; purpose
    
Sec. 5. (a) The commuter rail service advisory board isestablished. The commuter rail service advisory board has thefollowing members:
        (1) Two (2) members, each of whom must be a commuter railpassenger appointed by the commuter rail service board.
        (2) Two (2) members, each of whom must be a commuter raildivision employee appointed by the commuter rail serviceboard.
    (b) The members appointed under subsection (a)(1) must be

selected from passengers who have submitted a letter of interest tothe commuter rail service board. To be considered for this position,a passenger must submit a letter of interest to the commuter railservice board during a two (2) week period that begins sixty (60)days before the expiration of the term of the member to be appointed.A passenger member of the board is not required to submit a letter ofinterest to be eligible for appointment to a successive term.
    (c) The members appointed under subsection (a)(2) must beselected from a list of names submitted by the labor unionrepresenting the employees of the commuter rail service division.
    (d) A member of the commuter rail service advisory board shallserve for a term of two (2) years from the beginning of the term forwhich the member was appointed and until a successor has qualifiedfor the office. Each member shall serve at the pleasure of theappointing authority but is eligible for reappointment for successiveterms.
    (e) The members of the commuter rail service advisory boardshall elect for a one (1) year term:
        (1) one (1) member as chairperson;
        (2) one (1) member to serve as vice chairperson; and
        (3) one (1) member to serve as secretary.
    (f) Ninety (90) days before the expiration of the term of thecommuter rail service advisory board member appointed undersubsection (a)(1), the rail service division shall post in eachcommuter station in the district a notice of the opening on thecommuter rail service advisory board. The notice must announce theopening for two (2) passenger members on the commuter rail serviceadvisory board and provide information on submitting a letter ofinterest. The notice must state the period in which the passenger mustsubmit a letter of interest. The notice must remain posted until theexpiration of the two (2) week period described in subsection (b).
    (g) The commuter rail service advisory board shall meet:
        (1) at least quarterly at the call of the chairperson of thecommuter rail service advisory board; or
        (2) as requested by the commuter rail service board.
    (h) The commuter rail service advisory board shall, as considerednecessary by the commuter rail service advisory board or asrequested by the commuter rail service board, study issues and makerecommendations concerning matters affecting the rail servicedivision.
