Bus service board established
    
Sec. 1. A regional demand and scheduled bus service board isestablished for the district. The bus service board is the governingbody of the bus service division.

Bus service board membership
    
Sec. 2. (a) The bus service board is composed of the followingmembers:
        (1) One (1) member of the Lake County fiscal body, appointedby the Lake County fiscal body (if the county is a membercounty).
        (2) One (1) member of the Porter County fiscal body, appointedby the Porter County fiscal body (if the county is a membercounty).
        (3) The mayor of each city that meets both of the followingconditions:
            (A) The city has a population of at least twenty-fivethousand (25,000).
            (B) The city is located in Lake County or Porter County andthat county is a member county.
    (b) A member described in subsection (a)(1) or (a)(2) serves at thepleasure of the appointing authority.
    (c) If an appointing authority fails to make the requiredappointment to the board within sixty (60) days after a vacancy existson the board, the appointment shall be made by the governor fromthe individuals eligible to fill the position.

Bus service board member compensation
    
Sec. 3. A member of a bus service board is not entitled to receivecompensation for performance of the member's duties. However, amember of the bus service board who is not an elected official isentitled to a per diem from the district for the member's participationin bus service board meetings. The amount of the per diem is equalto the amount of the per diem provided under IC 4-10-11-2.1(b).

Sec. 4. A majority of the members appointed to the bus serviceboard constitutes a quorum for a meeting.

Sec. 5. The affirmative votes of at least a majority of theappointed members of the bus service board are necessary toauthorize any action of the district.

Sec. 6. The bus service board shall elect a chairperson of the busservice board and any other officers that the bus service boarddetermines appropriate.

Bus service board meetings at the call of the chairperson or twomembers
    
Sec. 8. The chairperson of a bus service board or any two (2)members of the bus service board may call a meeting of the busservice board. The chairperson of the bus service board shall call theinitial meeting of the bus service board for a date that is not morethan thirty (30) days after the bus service board is initiallyestablished.

Sec. 9. The bus service board may adopt those bylaws and rulesthat the bus service board considers necessary for the proper conductof the bus service board's duties and the safeguarding of the district'sfunds and property.

Powers of bus service board
    
Sec. 10. Subject to this article, the bus service board has thefollowing powers in Lake County and Porter County (if the countyis a member county):
        (1) The powers granted by IC 36-9-3 or any other law to theboard of a regional transportation authority.
        (2) The powers granted to the bus service board under thisarticle.

Sec. 11. The bus service division has the following powers inLake County and Porter County (if the county is a member county):
        (1) The powers granted by IC 36-9-3 or any other law to aregional transportation authority to operate a bus publictransportation system.
        (2) The powers granted to the bus service division under thisarticle.

Sec. 12. The powers of the bus service board and division may beexercised only in Lake County and Porter County (if the county is amember county).

Bus service division operations
    
Sec. 13. The bus service division shall operate in the mannerprovided for a regional transportation authority under IC 36-9-3,except that:
        (1) this article applies if there is a conflict between this articleand IC 36-9-3; and
        (2) an action authorized or permitted under IC 36-9-3 (otherthan the appointment or removal of members of the bus serviceboard) by the executive, fiscal body, or legislative body of amunicipality or county shall be taken by the board.

Sec. 14. The bus service board shall appoint an executive directorof the bus service division to manage the division. To be employedas executive director, the individual must have at least five (5) yearsexperience in public transportation at a senior executive level.

Bus service advisory board established; membership; meetings;duties
    
Sec. 15. (a) The bus service advisory board is established. The busservice advisory board has the following members:
        (1) Two (2) members, each of whom must be a bus passengerappointed by the bus service board.
        (2) Two (2) members, each of whom must be a bus divisionemployee appointed by the bus service board.
    (b) The members appointed under subsection (a)(1) must beselected from passengers who have submitted a letter of interest to

the bus service board. To be considered for this position, a passengermust submit a letter of interest to the bus service board during a two(2) week period that begins sixty (60) days before the expiration ofthe term of the member to be appointed. A passenger member of thebus service board is not required to submit a letter of interest to beeligible for appointment to a successive term.
    (c) The members appointed under subsection (a)(2) must beselected from a list of names submitted by the labor unionrepresenting the employees of the bus service division.
    (d) A member of the bus service advisory board shall serve for aterm of two (2) years from the beginning of the term for which themember was appointed and until a successor has qualified for theoffice. Each member shall serve at the pleasure of the appointingauthority but is eligible for reappointment for successive terms.
    (e) The members of the bus service advisory board shall elect fora one (1) year term:
        (1) one (1) member as chairperson;
        (2) one (1) member to serve as vice chairperson; and
        (3) one (1) member to serve as secretary.
    (f) Ninety (90) days before the expiration of the term of the busservice advisory board member appointed under subsection (a)(1),the bus service division shall post in each bus a notice of the openingon the bus service advisory board. The notice must announce theopening for two (2) passenger members on the bus service advisoryboard and provide information on submitting a letter of interest. Thenotice must state the period in which the passenger must submit aletter of interest. The notice must remain posted until the expirationof the two (2) week period described in subsection (b).
    (g) The bus service advisory board shall meet:
        (1) at least quarterly at the call of the chairperson of the busservice advisory board; or
        (2) as requested by the bus service board.
    (h) The bus service advisory board shall, as considered necessaryby the bus service advisory board or as requested by the bus serviceboard, study issues and make recommendations concerning mattersaffecting the bus service division.
