Chapter 7. General Powers of the District

Duty to exercise powers granted to carry out the purposes of thedistrict

Sec. 2. The district may sue and be sued in the name of thedistrict.

Power to determine internal organization and operatingprocedures not specified by law
Sec. 3. The district may determine matters of policy regardinginternal organization and operating procedures not specificallyprovided for by law.

Power to employ personnel
Sec. 4. The district may employ the personnel necessary to carryout the duties, functions, and powers of the district.

Power to fix compensation of officers and employees
Sec. 5. The district may fix the compensation of the variousofficers and employees of the district, within the limitations of thetotal personal services budget.

Power to adopt personnel rules
Sec. 6. The district may adopt rules governing the duties of itsofficers, employees, and personnel, and the internal management ofthe affairs of the district.

Power to protect property and obtain insurance
Sec. 7. The district may protect all property owned or managed bythe district and procure insurance against any losses in connectionwith its property, operations, or assets in amounts and from insurersas it considers desirable.As added by P.L.182-2009(ss), SEC.282.

Power to receive gifts
Sec. 8. The district may receive gifts, donations, bequests, andpublic trusts, agree to conditions and terms accompanying them, andbind the district to carry them out.

Power to receive and administer federal or state aid
Sec. 9. (a) The district may receive federal or state aid andadminister that aid.
(b) The district may comply with federal statutes and rulesconcerning the expenditure of federal money for publictransportation systems. The board may apply to state and federalagencies for grants for public transportation development, make orexecute representations, assurances, and contracts, enter intocovenants and agreements with any state or federal agency relativeto public transportation systems, and comply with federal and statestatutes and rules concerning the acquisition, development,operation, and administration of public transportation systems.
(c) The district may use money received by the district that is notpledged or restricted for another purpose to provide a local matchrequired for the receipt of any federal funds.

Powers concerning advertising
Sec. 10. At the request of a service board, the district may sell,lease, or otherwise contract for advertising in or on the facilities ofthe district.

Power to determine public transportation services provided by thedistrict
Sec. 11. The district may determine the level and kind of publictransportation services to be provided by the district.

Sec. 12. The district may do all other acts necessary or reasonablyincident to carrying out the purposes of this article.
