    Chapter 5. Railroad.Application of Eminent Domain

Purposes authorized by charter
    Sec. 1. Any railroad company organized under Indiana statutes butnot under IC 8-4-1, may adopt the provisions of that chapter forcondemning real estate; provided, that nothing in this sectioncontained shall be deemed or held to authorize such corporations tocondemn for any purpose or to any extent not authorized by itscharter, but such company adopting the provisions of that chaptershall not condemn more, or for any purpose than as authorized by itscharter; neither shall such corporation be deemed to havesurrendered or abandoned its charter by condemning real estate asauthorized in this section.
