Construction; unobstructed view between fireman and engineer
Sec. 1. In addition to the powers granted the Indiana departmentof transportation in other statutes, the department shall investigatewhether or not locomotive engines are constructed and built so thatthe engineer and fireman employed and working thereon andoperating the locomotive engine are, at all times when operating thelocomotive engine, in plain view and sight of each other and sosituated and located in the performance of their duties that when soat work, engaged in operating and running the locomotive engines,there are no walls, partitions, machinery, parts, or appliances of theengine or other obstructions to prevent the fireman and engineerfrom readily, quickly, and easily seeing and communicating witheach other.

Enforcement orders
Sec. 2. If, after investigation, it is found that the engines are notconstructed and operated as set out in section 1 of this chapter, theIndiana department of transportation may make and enforce againstthe railroad companies an order or orders as necessary to require theequipment of the locomotive engines to comply with section 1 of thischapter.

Front cab windows; unobstructed view; switch engines;unobstructed view
Sec. 3. The Indiana department of transportation may requirelocomotive engines to be so constructed that the engineer andfireman's view ahead from the front cab windows is clear andunobstructed by any part of the engine, equipment, or appliancesused or operated, and constructed that the cab deck shall be of thesame height, and shall give the fireman and engineer operating thelocomotive engine an even surface to stand and work upon, andconstructed that the switch engines have the tank and tender built sothat the engineer and fireman operating and controlling thelocomotive engine can have a clear view along the track, both frontand rear, without the view being obstructed by part of the engine,tank, or tender.

IC 8-8-3-4 Rebuilding or reconstruction
Sec. 4. Whenever a locomotive engine is sent to the shops of therailroad company operating the locomotive engine to be rebuilt orreconstructed, the locomotive engine shall be rebuilt or reconstructedso as to comply with this chapter. The Indiana department oftransportation may exempt a company from complying with thischapter.

Violations
Sec. 5. A person who violates an order of the Indiana departmentof transportation made under this chapter commits a Class Cinfraction.
