    Chapter 1. Railroad Employee Rules

Publication and distribution; violation
    
Sec. 1. (a) A person operating trains by steam power on railroadsshall:
        (1) publish printed rules for the control and operation of thosetrains;
        (2) deliver copies of the rules to all persons engaged in theoperation of those trains;
        (3) file a copy of the rules with the Indiana department oftransportation;
        (4) instruct employees in the application of those rules; and
        (5) examine employees about the rules at least once each six (6)months after employment until the service has continued foreighteen (18) months and at least once every two (2) yearsthereafter.
    (b) A person who fails to comply with this section commits aClass C infraction.

Intoxication while on duty
    
Sec. 3. It is a Class C infraction for an agent, officer, or employeeof any person engaged in the operation of railroad trains by steampower to be or become intoxicated while in the performance of hisduties or to operate any such train or give orders or directions for theoperation of any such train contrary to the printed rules of hiscompany required by section 1 of this chapter.

Fatal accidents; rules violations; reports to prosecuting attorney
    
Sec. 4. Whenever the Indiana department of transportation, in theinvestigation of an accident involving loss of life, concludes that theaccident occurred on account of the violation of the printed rules forthe operation of trains, as required by section 1 of this chapter, by anofficer or employee of a railroad company in this state, thedepartment may, if the neglect of duty or violation of the rules is

flagrant or has been brought about by the intoxication of a personwhile on duty, report the person to the prosecuting attorney of thecounty wherein the accident occurred for prosecution.
