    Chapter 7. Pilot Engineers on Detoured Trains

Duty to provide pilot engineer, conductor, or motorman
    
Sec. 1. In all cases which may arise from and after March 6, 1913,where it shall be necessary or convenient for any person, firm, orcorporation, or the lessee or receiver of any person, firm, orcorporation, owning, or operating any line or lines of steam orinterurban railroad in this state to detour any train or trains or car orcars owned or operated by them from their own track or tracks to thetrack or tracks of any other person, firm, or corporation, or the lesseeor receiver of any person, firm, or corporation, owning or operatingany similar line or lines of steam or interurban railroad in this state,and to obtain and procure the temporary use of the track or tracks,such person, firm, or corporation, or the lessee or receiver of anysuch person, firm, or corporation shall be required to secure andprovide a pilot engineer, conductor, or motorman or other person ofequal responsibility who is familiar with the road or roads overwhich it is necessary or convenient to run such train or trains or caror cars to reach the point or points which constitute the destinationof such train or trains or car or cars, or the point at which such roador roads communicate or connect with such other road or roads overwhich it is likewise necessary or convenient to run such train ortrains or car or cars, or the point or points at which such or any suchroad or roads communicate or connect with the road or roads fromwhich such train or trains or car or cars were originally detoured.And the person, firm, or corporation, or the lessee or receiver of anyperson, firm, or corporation owning such railroad or railroads overwhich it is necessary or convenient for such train or trains or car orcars to pass, as provided in this chapter, shall provide and place atthe disposal of such person, firm, or corporation, or the lessee orreceiver of any person, firm, or corporation, a capable pilot engineeror engineers, or motorman, conductor, or other person of equalresponsibility who is or are familiar with any or all of the road orroads over which it is necessary or convenient for such train or trainsor car or cars to pass to reach their destination.

Violation; penalty
    
Sec. 2. Any person, firm, or corporation, or lessee or receiver ofany person, firm, or corporation, owning or operating any line orlines of steam railroad in this state who shall violate any of theprovisions of this chapter by failing or refusing to provide such pilotengineer or other person as provided in section 1 of this chapter shallforfeit and pay to the state of Indiana the sum of fifty dollars ($50)for each and every offense, and each and every day that the violationof any of the provisions of this chapter shall continue shall be

deemed to constitute a separate and distinct offense.
