    Chapter 4. Driver Licensing Medical Advisory Board

Creation
    Sec. 1. The commissioner shall create a driver licensing medicaladvisory board.

Members
    Sec. 2. The board consists of five (5) members, of whom:
        (1) two (2) members must have unlimited licenses to practicemedicine in Indiana, including one (1) neurologist withexpertise in epilepsy; and
        (2) one (1) member must be licensed as an optometrist.
The board members serve at the pleasure of the commissioner.

Travel expenses; per diem salaries
    Sec. 3. A board member is entitled to be reimbursed for travelexpenses necessarily incurred in the performance of the member'sduties and is also entitled to receive a salary per diem as prescribedby the budget agency.

Duties
    Sec. 4. The board shall provide the commissioner and the officeof traffic safety created by IC 9-27-2-2 with assistance in theadministration of Indiana driver licensing laws, including:
        (1) providing guidance to the commissioner in the area oflicensing drivers with health or other problems that mayadversely affect a driver's ability to operate a vehicle safely;
        (2) recommending factors to be used in determiningqualifications and ability for issuance and retention of a driver'slicense; and
        (3) recommending and participating in the review of licensesuspension, restriction, or revocation appeal procedures,including reasonable investigation into the facts of the matter.

Requests for assistance
    Sec. 5. The commissioner may request assistance from any of theboard members at any time.

Immunity from civil action
    Sec. 6. A member of the board is exempt from a civil actionarising or thought to arise from an action taken in good faith as amember of the board.

Practice of medicine
    Sec. 7. The evaluation of medical reports for the commissioner bya member of the board does not constitute the practice of medicine.This chapter does not authorize a person to engage in the practice ofthe healing arts or the practice of medicine as defined by law.
