Chapter 5. Parking Placards for Persons With Physical Disabilities

Qualification for issuance of placard
Sec. 1. The bureau shall issue a placard to the following:
(1) An individual of any age who:
(A) has a temporary or permanent physical disability thatrequires the use of a wheelchair, a walker, braces, orcrutches;
(B) has temporarily or permanently lost the use of one (1) orboth legs;
(C) is certified to be severely restricted in mobility, eithertemporarily or permanently, due to a pulmonary orcardiovascular disability, arthritic condition, or orthopedicor neurological impairment, by:
(i) a physician having an unlimited license to practicemedicine;
(ii) a physician who is a commissioned medical officer ofthe armed forces of the United States or of the UnitedStates Public Health Service;
(iii) a physician who is a medical officer of the UnitedStates Department of Veterans Affairs;
(iv) a chiropractor licensed under IC 25-10-1;
(v) a podiatrist licensed under IC 25-29-1; or
(vi) an advanced practice nurse licensed under IC 25-23;or
(D) is certified by an optometrist or ophthalmologistlicensed to practice in Indiana to be blind or visuallyimpaired.
(2) Any corporation, limited liability company, partnership,unincorporated association, and any legal successor of thecorporation, limited liability company, partnership, orassociation, empowered by the state or a political subdivisionto operate programs, including the provision of transportation,or facilities for persons with physical disabilities.

Physician certification form
Sec. 2. The certification made by a physician, an optometrist, oran ophthalmologist under section 1(1)(C) or 1(1)(D) of this chaptermust be on a form prescribed by the state board of accounts and muststate the expected duration of the condition that severely restricts the
individual's mobility.

Contents of placard
Sec. 3. The placard required under section 1 of this chapter mustcontain the following:
(1) The words "Parking Permit for Persons with PhysicalDisabilities".
(2) An expiration date.

Duration of placard; permanent and temporary disability
Sec. 4. (a) A placard issued under section 1(1) of this chapterexpires on the recipient's fourth birthday that follows the date of theplacard's issuance if the recipient's disability is permanent. If thedisability is permanent, a new physician certification is not requiredupon expiration of the placard, only reapplication.
(b) If the recipient's disability is not permanent, a placard issuedunder section 1(1) of this chapter expires:
(1) six (6) months after the date of the placard's issuance; or
(2) on the date certified by a physician under section 1(1)(C) or1(1)(D) of this chapter;
whichever occurs first.

Operators of programs and facilities for handicapped individuals;expiration of placard upon ceasing operations
Sec. 5. A placard issued under section 1(2) of this chapter expireson January 1 of the fourth year that follows the date of the placard'sissuance. However, if the corporation, limited liability company,partnership, or unincorporated association ceases to operateprograms or facilities for persons with physical disabilities beforeJanuary 1 of the fourth year that follows the date of the placard'sissuance, the placard expires on the date the operation of theprograms or facilities for persons with physical disabilities ceases.

Placard recipients; instructions on law governing parking forpersons with physical disabilities
Sec. 6. When issuing a placard under this chapter, the bureau shallprovide the individual to whom a placard is issued instructions
explaining the law governing parking for a person with a physicaldisability and explaining proper use of the placard.

Display of placard; duplicate placards
Sec. 7. A placard issued under this chapter must be displayed onthe dashboard of a motor vehicle that is parked in a parking spacereserved for persons with physical disabilities under this chapterunless the motor vehicle bears a license plate for a person with adisability issued under IC 9-18-22, a disabled Hoosier veteran'slicense plate issued under IC 9-18-18, or an equivalent parkingpermit issued under the laws of another state. If a placard is lost,stolen, damaged, or destroyed, the bureau shall provide a duplicateplacard upon the application of the person who was issued theplacard.

Fees
Sec. 8. The bureau may establish by rule and charge a fee of notmore than five dollars ($5) to cover the cost of issuing a placardunder this chapter to a individual having a temporary disability.However, the bureau may not establish or charge a fee for issuing aplacard under this chapter to an individual having a permanentdisability.

False representation of qualification for receipt of placard; offense
Sec. 9. A person who knowingly and falsely represents the personas having the qualifications to obtain a placard issued under thischapter commits a Class C misdemeanor.
