Creation; character
Sec. 1. The bureau of motor vehicles commission is established.The commission is a body corporate and politic, and though separatefrom the state, the exercise by the commission of the commission'spowers constitutes an essential governmental function. Thecommission may sue and be sued and plead and be impleaded.

Membership
Sec. 2. The commission consists of the following five (5)individuals:
(1) Four (4) individuals, not more than two (2) of whom may bemembers of the same political party, who:
(A) shall be appointed by the governor;
(B) serve for terms of four (4) years;
(C) may not hold any other public office or serve as a stateor local employee while serving as a commission member;and
(D) shall devote as much time as is needed to carry out theirduties, but are not required to devote full time to their duties.
(2) The commissioner, who:
(A) shall serve as chairman of the commission; and
(B) is responsible for calling commission meetings.

Quorum
Sec. 3. Three (3) commission members constitute a quorum. Theconsent of three (3) commission members is required before anyaction may be taken.

Per diem salaries; expenses
Sec. 4. (a) Each member of the commission who is not a stateemployee is entitled to the minimum salary per diem provided byIC 4-10-11-2.1(b). That member is also entitled to reimbursement fortraveling expenses and other expenses actually incurred inconnection with the member's duties, as provided in the state travelpolicies and procedures established by the Indiana department of
administration and approved by the budget agency.
(b) Each member of the commission who is a state employee isentitled to reimbursement for traveling expenses and other expensesactually incurred in connection with the member's duties, as providedin the state travel policies and procedures established by the Indianadepartment of administration and approved by the budget agency.
