Chapter 2. Leasing or Purchasing License Branch Facilities

Procurement defined
Sec. 1. As used in this chapter, "procurement" means a purchase(as defined in IC 5-22-2-24).

Office and storage space; parking facilities
Sec. 2. Subject to the approval of the commission, the bureau mayrequest the necessary office space, storage space, and parkingfacilities for each license branch operated by the commission fromthe Indiana department of administration as provided inIC 4-20.5-5-5.

Appraisal; supplies, fixtures, and equipment; real property; leaseagreements and contracts
Sec. 3. The value of all:
(1) purchases of supplies, fixtures, and equipment;
(2) purchases of real property; and
(3) lease agreements and contracts;
shall be appraised by the Indiana department of administration or byan independent appraiser, at the discretion of the Indiana departmentof administration. The cost of a purchase, lease agreement, orcontract may not exceed the appraised value.

Tax exempt property
Sec. 4. Property of the commission is public property devoted toan essential public and governmental function and purpose and isexempt from all taxes and special assessments of the state or apolitical subdivision of the state.

Procurement system
Sec. 5. (a) Notwithstanding IC 5-16, IC 5-17-1, and IC 5-22, thecommission may develop a system of procurement that applies onlyto procurement of equipment, materials, and goods required for theoperation of license branches.
(b) A system of procurement adopted under this section mustprovide that whenever:
(1) a contract is awarded by acceptance of bids, proposals, orquotations; and
(2) a trust (as defined in IC 30-4-1-1(a)) submits a bid, proposal,
or quotation;
the bid, proposal, or quotation must identify each beneficiary of thetrust and each settlor empowered to revoke or modify the trust.
(c) This section does not apply to the purchasing, leasing, ordisposal of real property.
