Chapter 11. Intercity Buses

Application of chapter
Sec. 1. This chapter does not apply to the following:
(1) The regulation of motor buses operated in interstatecommerce under IC 8-2.1.
(2) Special and charter bus operations when the buses:
(A) are operating in interstate commerce; and
(B) have been granted reciprocity under reciprocalagreements entered into by Indiana and the state in which thebuses are domiciled or based.

Preceding year defined
Sec. 2. As used in this chapter, "preceding year" means a periodof twelve (12) consecutive months fixed by the bureau that is withinthe sixteen (16) months immediately preceding the commencementof the registration year for which proportional registration is sought.

Registration applications; contents
Sec. 3. A person engaged in operating at least one (1) fleet ofintercity buses may, instead of registering the buses under any otherlaw, register each fleet for operation in Indiana by filing anapplication with the bureau that contains the following information:
(1) The total number of miles operated in all states during thepreceding year by the intercity buses in the fleet.
(2) The total number of miles operated in Indiana during thepreceding year by the intercity buses in the fleet.
(3) A description and identification of each intercity bus in thefleet that is to be operated in Indiana during the registration yearfor which proportional fleet registration is requested.
(4) Any other information requested by the bureau.

Registration and licensing
Sec. 4. The bureau shall:
(1) register the intercity buses described and identified; and
(2) issue:
(A) a license plate;
(B) a distinctive sticker; or
(C) another suitable identification device;
for each bus described in the application;
upon payment of the appropriate fees for the application and for thelicense plates, stickers, or devices issued.As added by P.L.2-1991, SEC.6.

Certificates of registration
Sec. 5. (a) A certificate of registration shall be issued for eachproportionally registered intercity bus.
(b) A certificate of registration:
(1) must, in addition to the information required byIC 9-18-2-20, bear upon the certificate's face the number of the:
(A) license;
(B) sticker; or
(C) other device;
issued for a proportionally registered bus; and
(2) shall be carried in the intercity bus for which the card wasissued at all times.

Full registration; exception
Sec. 6. A fleet intercity bus registered and identified is consideredto be fully registered in Indiana for any type of movement oroperation, except in those instances in which a grant of authority isrequired for intrastate movement or operation.

Out-of-state registration required
Sec. 7. Proportional registration of fleet intercity buses under thischapter is subject to the condition that each fleet intercity busproportionally registered under this chapter is also proportionally orotherwise properly registered in at least one (1) other state during theperiod for which the intercity bus is proportionally registered inIndiana.

Additional buses; registration formula
Sec. 8. A person who acquires ownership of an intercity bus afterthe commencement of the registration year and subsequently adds toa proportionally registered fleet shall be proportionally registered byapplying the mileage percentage used in the original application forthe fleet for the registration period to the regular registration fees duewith respect to the intercity bus for the remainder of the registrationyear.

Withdrawal of buses; notification; surrender of registration cardsand identification devices
Sec. 9. (a) If an intercity bus is withdrawn from a proportionally
registered fleet during the period for which the bus is registeredunder this chapter, the person who owns the fleet shall notify thebureau on forms prescribed by the bureau.
(b) The bureau may require the person to surrender proportionalregistration cards and other identification devices that have beenissued with respect to an intercity bus that the bureau considersadvisable.

Initial applications
Sec. 10. (a) The initial application for proportional registration ofa fleet must state the mileage data with respect to the fleet for thepreceding year in Indiana and other states.
(b) If operations were not conducted with a fleet during thepreceding year, the application must contain a full statement of theproposed method of operation and estimates of annual mileage inIndiana and other states.
(c) The bureau may deny the application if the bureau is notsatisfied with the correctness of the application.

Records; preservation; audits
Sec. 11. (a) A person who owns an intercity bus whoseapplication for proportional registration has been accepted shallpreserve the records on which the application is based for a period offour (4) years following the year or period upon which theapplication is based.
(b) Upon request of the bureau, the person shall make the recordsavailable to the bureau at the bureau's office for audit as to accuracyof computations and payments or to pay the reasonable costs of anaudit at the home office of the person by an appointed representativeof the bureau.
(c) The bureau may make arrangements with agencies of otherstates administering motor vehicle registration laws for joint auditsof any owner.

Authority for registration
Sec. 12. This chapter constitutes complete authority for theregistration of fleet buses upon a proportional registration basiswithout reference to or application of any other statutes, except asprovided.

Rules
Sec. 13. The bureau may adopt rules necessary to carry out the
administration and enforcement of this chapter.

Buses operated in International Registration Plan states;registration
Sec. 14. Intercity buses, except charter buses, that operate in statesthat are members of the International Registration Plan are subject toregistration under the plan.
