Chapter 35. Indiana Food Bank Trust License Plates

"Indiana food bank" defined
Sec. 1. As used in this chapter, "Indiana food bank" means anorganization that:
(1) is a charitable organization under Section 501(c) of theInternal Revenue Code;
(2) is registered to do business in Indiana;
(3) is located within Indiana;
(4) is a member of a national network of food banks;
(5) collects and temporarily stores donated food; and
(6) distributes donated food only to organizations that:
(A) are charitable organizations under Section 501(c) of theInternal Revenue Code; and
(B) distribute donated food to people in Indiana.

Design and issuance of plates
Sec. 2. The bureau shall design and issue an Indiana food banktrust license plate. The Indiana food bank trust license plate must bedesigned and issued as a special group recognition license plateunder IC 9-18-25.

Eligibility
Sec. 3. After December 31, 1999, a person who is eligible toregister a vehicle under this title is eligible to receive an Indiana foodbank trust license plate under this chapter upon doing the following:
(1) Completing an application for an Indiana food bank trustlicense plate.
(2) Paying the appropriate fee under section 4 of this chapter.

Fees
Sec. 4. (a) The fee for an Indiana food bank trust license plate isas follows:
(1) The appropriate fee under IC 9-29-5-38.
(2) An annual fee of twenty-five dollars ($25).
(b) The annual fee referred to in subsection (a)(2) shall becollected by the bureau.
(c) The annual fee described in subsection (a)(2) shall bedeposited in the Indiana food bank trust fund established by section5 of this chapter.

Food bank trust fund
Sec. 5. (a) The Indiana food bank trust fund is established.
(b) The treasurer of state shall invest the money in the Indianafood bank trust fund not currently needed to meet the obligations ofthe Indiana food bank trust fund in the same manner as other publictrust funds are invested. Interest that accrues from these investmentsshall be deposited in the Indiana food bank trust fund.
(c) The bureau shall administer the Indiana food bank trust fund.Expenses of administering the Indiana food bank trust fund shall bepaid from money in the Indiana food bank trust fund.
(d) On June 30 of each year, the bureau shall distribute money inthe fund attributable to a recipient of an Indiana food bank trustlicense plate to the Gleaners food bank trust license plate committeethat is composed of representatives of each food bank located inIndiana.
(e) Money in the fund at the end of a state fiscal year does notrevert to the state general fund.
