Chapter 13. School Bus Design and Equipment

State school bus committee rules; contracts for pupiltransportation; school district officers and employees
Sec. 1. The state school bus committee established byIC 20-27-3-1 shall adopt and enforce rules under IC 4-22-2 notinconsistent with this chapter to govern the design and operation ofall school buses used for the transportation of school children whenowned and operated by a school corporation or privately owned andoperated under contract with an Indiana school corporation. Therules must by reference be made a part of such a contract with aschool corporation. Each school corporation, officer and employeeof the school corporation, and person employed under contract by aschool district is subject to those rules.

Misconduct of school corporation officers or employees
Sec. 2. An officer or employee of a school corporation who:
(1) violates any of the rules adopted by the state school buscommittee concerning the design and operation of school buses;or
(2) fails to include an obligation to comply with those rules ina contract executed by the officer or employee on behalf of aschool corporation;
is guilty of misconduct and subject to removal from office oremployment.

Failure by contract operators to comply with rules; breach ofcontract
Sec. 3. A person operating a school bus under contract with aschool corporation who fails to comply with any of the rules adoptedby the state school bus committee concerning the design andoperation of school buses is guilty of breach of contract. The contractmay be canceled after notice and hearing by responsible officers ofthe school corporation.

Equipment required
Sec. 4. A bus used to transport school children must be equippedas follows:
(1) At least two (2) signal lamps mounted as high and as widelyspaced laterally as practicable, capable of displaying the fronttwo (2) alternately flashing red lights located at the same level,and having sufficient intensity to be visible at five hundred
(500) feet in normal sunlight.
(2) As required by the state school bus committee underIC 20-27-3-4.
(3) As required by IC 20-27-9.

Red lamps; prohibited vehicles
Sec. 4.5. (a) Except for a vehicle utilized in a funeral procession,a vehicle that is not described by section 4 of this chapter may notdisplay a red lamp.
(b) Except as provided in subsection (c), a person who:
(1) purchases or otherwise acquires a vehicle with equipmentdescribed by section 4 of this chapter; and
(2) is not authorized to display a red lamp upon the vehicle;
shall immediately remove the red lamp from the vehicle.
(c) A person who:
(1) purchases or otherwise acquires a vehicle with equipmentdescribed by section 4 of this chapter; and
(2) uses the vehicle as a church bus;
is not required to remove the red lamp from the vehicle if the personrenders the red lamp inoperable.

United States Department of Transportation regulations;classification of violations
Sec. 5. (a) This section does not apply to a person who owns oroperates a vehicle or combination of vehicles that:
(1) contains parts and accessories; and
(2) is equipped;
as required under regulations of the United States Department ofTransportation.
(b) A person who violates section 4(1) of this chapter commits aClass C infraction.
