    Chapter 15. Special Equipment for Transporting Explosives

Emergency warning signals
    
Sec. 1. A person may not operate a motor vehicle for thetransportation of explosives unless the motor vehicle is equippedwith the equipment required under IC 9-19-5-6(d).

Compliance with chapter; federal regulation
    
Sec. 2. A person operating a vehicle transporting an explosive asa cargo or part of a cargo upon a highway shall comply with thischapter. This chapter does not apply to a vehicle transporting aninterstate shipment or shipments that is otherwise in compliance withthe regulations of the Interstate Commerce Commission or otherfederal agency governing the transportation of explosives and otherdangerous articles, including requirements for placarding.

Placarding and danger flags
    
Sec. 3. A vehicle transporting explosives must meet one (1) of thefollowing requirements:
        (1) Be marked or placarded on each side and the rear with theword "explosives" in letters not less than eight (8) inches high.
        (2) Have displayed on the rear of the vehicle a red flag not lessthan twenty-four (24) inches square marked with the word"danger" in white letters six (6) inches high.

Fire extinguishers
    
Sec. 4. A vehicle transporting explosives must be equipped withnot less than two (2) fire extinguishers, filled and ready forimmediate use and placed at a convenient point on the vehicle.

United States Department of Transportation regulations;classification of violations
    
Sec. 5. (a) This section does not apply to a person who owns oroperates a vehicle or combination of vehicles that:
        (1) contains parts and accessories; and
        (2) is equipped;
as required under regulations of the United States Department ofTransportation.
    (b) A person who violates this chapter commits a Class Cinfraction.As added by P.L.2-1991, SEC.7.
