Manufacture, installation and maintenance; safety requirements
    
Sec. 1. Air conditioning equipment shall be manufactured,installed, and maintained with due regard for the safety of theoccupants of the vehicle and the public and may not contain arefrigerant that is toxic to individuals or that is flammable, unless therefrigerant is included in the list published by the United StatesEnvironmental Protection Agency as a safe alternative motor vehicleair conditioning substitute for chlorofluorocarbon-12 under 42U.S.C. 7671k(c).

Selling or equipping vehicle with noncomplying equipment
    
Sec. 2. A person may not:
        (1) have for sale;
        (2) offer for sale; or
        (3) sell or equip;
a motor vehicle with air conditioning equipment unless theequipment complies with this chapter.

Sec. 3. A person may not operate on a highway a motor vehicleequipped with air conditioning equipment unless the air conditioningequipment complies with this chapter.

United States Department of Transportation regulations;classification of violations
    
Sec. 4. (a) This section does not apply to a person who owns oroperates a vehicle or combination of vehicles that:
        (1) contains parts and accessories; and
        (2) is equipped;
as required under regulations of the United States Department ofTransportation.
    (b) A person who violates this chapter commits a Class Cinfraction.
