Chapter 14. Special Restrictions Concerning Tractor-MobileHome Rigs and Required Permits

Permit requirement
Sec. 1. Except as otherwise provided in section 4 of this chapter,a person may not operate a tractor-mobile home rig on an Indianahighway unless the person has a permit to operate the rig from:
(1) the Indiana department of transportation; or
(2) an agency or a political subdivision of the state designatedby the Indiana department of transportation to issue permits.

Conditions for granting permits; local authorities; jurisdiction
Sec. 2. (a) The Indiana department of transportation or any agencyor political subdivision of the state designated by the IndianaDepartment of Transportation shall grant a permit to operate atractor-mobile home rig on an Indiana highway to a person upon thefollowing conditions and upon the rules that the Indiana Departmentof Transportation prescribes:
(1) The tractor-mobile home rig must be operated in a mannerthat will not impede traffic or increase the hazard to traffic.
(2) The tractor-mobile home rig may be operated only on daysother than Sunday and the legal holidays that the Indianadepartment of transportation prescribes. The tractor-mobilehome rig may be operated between one-half (1/2) hour beforesunrise and one-half (1/2) hour after sunset on any weekday,and between one-half (1/2) hour before sunrise and noon onSaturday.
(3) The tractor-mobile home rig may be operated only over theroads or highways in the state highway system, including,except to the extent provided in section 5 of this chapter, theroutes designated as federal highways and the state maintainedroutes through cities and towns. The tractor-mobile home rigmay not extend past the center line of those roads andhighways.
(4) The person to whom the permit is granted shall presentsatisfactory evidence of the person's financial responsibility, asprovided in IC 9-25, to the granting authority.
(5) If in use as a towing vehicle component of a tractor-mobilehome rig, the towing vehicle for which the permit is grantedmust have a wheelbase of not less than one hundred twenty(120) inches.
(6) A permit granted for the towing vehicle component of atractor-mobile home rig may be suspended or revoked by theIndiana department of transportation for violation of any of theconditions of the permit set forth in this section.
(7) The towing vehicle may be operated only over the roads or
highways approved by the authority granting the permits.
(b) Except as provided in section 5 of this chapter, this sectiondoes not prevent a local authority with respect to highways and roadsunder the authority's jurisdiction from granting permission to operatea tractor-mobile home rig on roads and highways under theauthority's jurisdiction that are not highways in the state highwaysystem or state maintained routes through cities and towns.

General permits; special permits
Sec. 3. (a) An authority granting permits to operate tractor-mobilehome rigs shall grant permits of two (2) general classes, as follows:
(1) General permits, for the operation of tractor-mobile homerigs by a person, except a mobile home or sectionalized buildingowner, in the ordinary course of the person's business.
(2) Special permits, for the operation of a tractor-mobile homerig by a mobile home or sectionalized building owner for theexpress purpose of moving mobile homes or sectionalizedbuildings.
(b) General permits shall be issued annually. One (1) permit shallbe issued for each towing vehicle to be used as a component of atractor-mobile home rig. The holder of a general permit may make,during the period of the permit, any number of mobile home orsectionalized building movements with the towing vehiclecomponent of the tractor-mobile home rig for which the permit wasgranted.
(c) Special permits shall be limited to the particular movement ofthe mobile home or sectionalized building for which the specialpermit is issued. A person purchasing a mobile home or sectionalizedbuilding, but who does not have a legal title to the mobile home orsectionalized building, is considered the owner of the mobile homeor sectionalized building for the purposes of this chapter if the personhas a contract with the seller or the seller's assignee. However, sucha person shall present to the granting authority a statement by theholder of the legal title to the mobile home or sectionalized buildinggranting permission for the movement of the mobile home orsectionalized building.

Size and weight limitations
Sec. 4. A person may operate a vehicle towing a mobile home thathas:
(1) a combined overall length not greater than sixty (60) feet;
(2) a width not greater than ninety-six (96) inches; and
(3) a height not greater than thirteen (13) feet, six (6) inches;
without having to obtain a permit under this chapter.

Interstate highways; federal funds
Sec. 5. This chapter does not apply to interstate highways to theextent that the application of this chapter to those highways wouldcause the state to be deprived of any federal funds for highwaypurposes.

Quarterly or annual permit
Sec. 6. (a) This section applies to a person who purchases aquarterly or an annual permit under IC 9-29-6-7 to move atractor-mobile home rig.
(b) A person described in subsection (a) shall use only thepermissible routes for moving a tractor-mobile home rig. The personmust check the daily detour and restriction bulletin before choosinga route to travel. If the person moves a tractor-mobile home rig on aroute that is restricted or prohibited, the person's quarterly or annualpermit may be revoked.
(c) If a person's quarterly or annual permit is revoked undersubsection (b), the person may not obtain a new quarterly or annualpermit for a period of ninety (90) days. The person may move atractor-mobile home rig under a single trip permit until the person iseligible to obtain a new quarterly or annual permit.
