Chapter 14. Marching Bands

Application of chapter
Sec. 1. This chapter applies to an officially recognized performingorganization, including bands, dance units, drill teams, color guards,flag corps, or rifle squads of the following:
(1) A public school.
(2) A private school.
(3) A state supported college or university.
(4) A private college or university located in Indiana accreditedby a recognized regional accrediting agency.

Marching band procession
Sec. 2. As used in this chapter, "marching band procession" meansan officially recognized performing organization, including a band,dance unit, drill team, color guard, flag corps, or rifle squadperforming together or separately on a local road or street.

Right-of-way; requirements; exceptions
Sec. 3. (a) A marching band procession has the right-of-way on alocal road or street and at an intersection and may proceed on thelocal road or street and through the intersection if the procession isheaded by a person wearing a fluorescent jacket or a lead or escortvehicle displaying a revolving amber light with three hundred sixty(360) degree visibility, except under either of the followingconditions:
(1) When the right-of-way is required by an authorizedemergency vehicle.
(2) When the procession is directed otherwise by a policeofficer.
(b) A vehicle on the local road or street at the time the marchingband procession is proceeding must pull over on the local road orstreet and yield the right-of-way until the procession has passed thevehicle.
(c) A pedestrian may not physically interfere with a marchingband procession or the individuals in the procession.
(d) Before assuming the right-of-way, the marching bandprocession must exercise due caution with regard to crossing traffic.

Driving between vehicles of marching band procession;authorization
Sec. 4. A person who drives a vehicle that is not in a marching
band procession may not drive the vehicle between the vehicles ofthe marching band procession, except when:
(1) authorized to do so by a traffic officer; or
(2) the vehicle is an authorized emergency vehicle.

Formation of procession for purpose of securing right-of-way;prohibition
Sec. 5. A pedestrian and a person who drives a vehicle that is nota part of a marching band procession may not form a procession forthe purpose of securing the right-of-way granted by this section tomarching band processions.

Lead and escort vehicles; flashing amber lights
Sec. 6. The lead and escort vehicles in a marching bandprocession may be equipped with flashing amber lights. Therevolving amber lights may be used to gain the right-of-way on alocal road or street and at intersections and to protect a marchingband procession while crossing an intersection.

Ordinances regulating band processions
Sec. 7. Local units of government with jurisdiction over localroads and streets may adopt ordinances regulating marching bandprocessions.

Violations; Class C infraction
Sec. 8. A person who violates this chapter commits a Class Cinfraction.
