Chapter 1. Individuals Required to Obtain a License or Permit

License required
Sec. 1. Except as provided in section 6 or 7 of this chapter, anindividual must have a valid Indiana:
(1) operator's license;
(2) chauffeur's license;
(3) public passenger chauffeur's license;
(4) commercial driver's license;
(5) driver's license listed in subdivision (1), (2), (3) or (4) witha motorcycle operator's license or endorsement; or
(6) learner's permit;
issued to the individual by the bureau under this article to drive uponan Indiana highway the type of motor vehicle for which the licenseor permit was issued.

Applicability; standards for determining residency; exception
Sec. 1.5. (a) This section applies after December 31, 2005.
(b) The standards set forth in IC 3-5-5 to determine the residenceof an individual applying to become a voter apply to thedetermination of the residence of an individual applying for a licenseunder this article.
(c) This section does not prevent the commission from issuing alicense under this article to an individual who is:
(1) not required by this article to reside in Indiana to receive thelicense; and
(2) otherwise qualified to receive the license.

Chauffeur's license; necessity
Sec. 2. Except as provided in section 7 of this chapter, anindividual must have a valid Indiana chauffeur's license to operate amotor vehicle as a chauffeur upon an Indiana highway.

Medical service vehicle operation; requirements
Sec. 4. Except as provided in section 7 of this chapter, an
individual must:
(1) have a valid Indiana operator's, chauffeur's, or publicpassenger chauffeur's license; and
(2) be at least eighteen (18) years of age;
to drive a medical services vehicle upon an Indiana highway.

Motorcycle operation; required licenses
Sec. 5. An individual must have a valid driver's license that maybe any of the following to operate a motorcycle upon a publichighway:
(1) An operator's, a chauffeur's, or a public passengerchauffeur's license with a motorcycle endorsement.
(2) A temporary motorcycle learner's permit subject to thelimitations imposed under IC 9-24-8.
(3) A motorcycle learner's permit subject to the limitationsimposed under IC 9-24-8.
(4) A driver's license from any other jurisdiction that is valid forthe operation of a motorcycle in that jurisdiction.

Commercial driver's license; necessity; exception
Sec. 6. (a) Except as provided in subsection (b), an individualmust hold a valid Indiana commercial driver's license issued by thebureau under this article to drive a commercial motor vehicle afterMarch 31, 1992, upon an Indiana highway.
(b) Subsection (a) does not apply to an individual if theindividual:
(1) holds a valid driver's license of any type;
(2) is enrolled in a commercial motor vehicle training courseapproved by the bureau; and
(3) is operating a commercial motor vehicle under the directsupervision of a licensed commercial motor vehicle driver.

Exempt operators
Sec. 7. (a) Sections 1 through 5 of this chapter do not apply to thefollowing individuals:
(1) An individual in the service of the armed forces of theUnited States while operating an official motor vehicle in thatservice.
(2) An individual while operating:
(A) a road roller;
(B) road construction or maintenance machinery, exceptwhere the road roller or machinery is required to beregistered under Indiana law;
(C) a ditch digging apparatus; (D) a well drilling apparatus;
(E) a concrete mixer; or
(F) a farm tractor, a farm wagon (as defined inIC 9-13-2-60(a)(2)), or an implement of agriculture designedto be operated primarily in a farm field or on farm premises;
that is being temporarily drawn, moved, or propelled on apublic highway. However, to operate a farm wagon (as definedin IC 9-13-2-60(a)(2)) on a highway, an individual must be atleast fifteen (15) years of age.
(3) A nonresident who:
(A) is at least sixteen (16) years and one (1) month of age;
(B) has in the nonresident's immediate possession a validoperator's license that was issued to the nonresident in thenonresident's home state or country; and
(C) is lawfully admitted into the United States;
while operating a motor vehicle in Indiana only as an operator.
(4) A nonresident who:
(A) is at least eighteen (18) years of age;
(B) has in the nonresident's immediate possession a validchauffeur's license that was issued to the nonresident in thenonresident's home state or country; and
(C) is lawfully admitted into the United States;
while operating a motor vehicle upon a public highway, eitheras an operator or a chauffeur.
(5) A nonresident who:
(A) is at least eighteen (18) years of age; and
(B) has in the nonresident's immediate possession a validlicense issued by the nonresident's home state for theoperation of any motor vehicle upon a public highway whenin use as a public passenger carrying vehicle;
while operating a motor vehicle upon a public highway.
(6) An individual who is legally licensed to operate a motorvehicle in the state of the individual's residence and who isemployed in Indiana, subject to the restrictions imposed by thestate of the individual's residence.
(7) A new resident of Indiana who possesses an unexpireddriver's license issued by the resident's former state ofresidence, for a period of sixty (60) days after becoming aresident of Indiana.
(8) An individual who is an engineer, a conductor, a brakeman,or another member of the crew of a locomotive or a train that isbeing operated upon rails, including the operation of thelocomotive or the train on a crossing over a street or a highway.An individual described in this subdivision is not required todisplay a license to a law enforcement officer in connectionwith the operation of a locomotive or a train in Indiana.
(b) An ordinance adopted under IC 9-21-1-3((a)(14) orIC 9-21-1-3.3(a) must require that an individual who operates a golfcart in the city or town hold a driver's license.

Violations
Sec. 8. (a) Except as provided in subsection (b), a person whoviolates this chapter commits a Class C infraction.
(b) A person who violates section 6 of this chapter commits aClass C misdemeanor.
