Chapter 7. Learner's Permit

Issuance; conditions
Sec. 1. (a) This subsection expires June 30, 2010. The bureaushall issue a learner's permit to an individual who meets thefollowing conditions:
(1) Is at least fifteen (15) years of age.
(2) If less than eighteen (18) years of age, is not ineligible underIC 9-24-2-1.
(3) Is enrolled in an approved driver education course.
(b) This subsection applies beginning July 1, 2010. The bureaushall issue a learner's permit to an individual who meets thefollowing conditions:
(1) Is at least fifteen (15) years and one hundred eighty (180)days of age.
(2) If less than eighteen (18) years of age, is not ineligible underIC 9-24-2-1.
(3) Is enrolled in an approved driver education course.

Validation
Sec. 2. The bureau shall validate a learner's permit issued undersection 1 of this chapter upon certification by the instructor of anapproved driver education course that the holder has satisfactorilycompleted the course.

Issuance; age and examination requirements
Sec. 3. The bureau shall issue a validated learner's permit to anindividual who is at least sixteen (16) years of age upon passing therequired examination.

Operating privileges
Sec. 4. A learner's permit authorizes the permit holder to operatea motor vehicle, except a motorcycle, upon a public highway underthe following conditions:
(1) While the holder is participating in practice driving in anapproved driver education course and is accompanied by acertified driver education instructor in the front seat of anautomobile equipped with dual controls.
(2) If the learner's permit has been validated and the holder isless than eighteen (18) years of age, the holder may participatein practice driving if the seat beside the holder is occupied bya guardian, stepparent, or relative of the holder who is at least
twenty-one (21) years of age and holds a valid operator's,chauffeur's, or public passenger chauffeur's license.
(3) If the learner's permit has been validated and the holder is atleast eighteen (18) years of age, the holder may participate inpractice driving if accompanied in the vehicle by an individualwho holds a valid operator's, chauffeur's, or public passengerchauffeur's license.
(4) While:
(A) the holder is enrolled in an approved driver educationcourse;
(B) the holder is participating in practice driving after havingcommenced an approved driver education course; and
(C) the seat beside the holder is occupied by a parent,stepparent, or guardian of the holder who holds a validoperator's, chauffeur's, or public passenger chauffeur'slicense.

Operator's license examinations
Sec. 5. A holder of a learner's permit may take an examination foran operator's license not later than the expiration date of the learner'spermit. Not more than three (3) examinations may be allowed anyholder during the period the learner's permit is issued. A holder whodoes not pass the examination during the period for which thelearner's permit is issued must obtain a new learner's permit and isnot eligible to take the examination until two (2) months after theissuance of the new permit.

Violations
Sec. 6. A person who violates this chapter commits a Class Cinfraction.
