    Chapter 1. Federal Traffic Safety Programs

Federal act defined
    
Sec. 1. As used in this chapter, "federal act" refers to the NationalHighway Safety Act of 1966 (23 U.S.C. 401 et seq. as in effectJanuary 1, 1991).

Acceptance of provisions and benefits of National Highway SafetyAct of 1966; administration
    
Sec. 2. Indiana accepts the provisions and benefits of the NationalHighway Safety Act of 1966 (23 U.S.C. 401 et seq.). The governormay administer the federal act and coordinate the activities of alldepartments and agencies of this state and political subdivisions ofthis state and observe and comply with the requirements of thefederal act and the regulations issued under the federal act.

Construction to allow maximum participation in benefits
    
Sec. 3. This chapter shall be construed to allow maximumparticipation in the benefits of the federal act.

Federal funds appropriated to state and subdivisions for federalact uses and purposes
    
Sec. 4. Federal funds received by the state under the federal actare appropriated to the state and political subdivisions of the state forthe uses and purposes provided by the federal act.

Federal funds conditioned on expenditure of funds by politicalsubdivision; appropriation by subdivision
    
Sec. 5. If the expenditure of public funds of a political subdivisionis required as a condition for the provision of funds under the federalact, the acceptance of funds under the federal act by the politicalsubdivision shall be made by the governing authority of the politicalsubdivision, with the consent of the appropriating authority of thepolitical subdivision. Funds of a political subdivision may not beexpended without due appropriation as provided by law. However,a political subdivision may make regular appropriations for the

purposes authorized by this chapter or may make regularappropriations in the same manner that emergency appropriations aremade.

State administrator and other employees; salaries
    
Sec. 6. (a) The governor may appoint an administrator to aid thegovernor in the coordination and administration of the federal act.The governor may also employ other persons required to effectuatethe purposes of the federal act.
    (b) The budget agency, subject to the approval of the governor,shall establish the salaries of the administrator and other personsemployed by the governor to effectuate the purposes of the federalact.

Delegation of duties to state officers or agencies
    
Sec. 7. The governor may designate a state officer or agency toperform any of the acts to be performed by the state to receive fundsunder the federal act. The designated state officer or agency shallperform the acts specified by the governor.

Cooperation; federal, state, and local level
    
Sec. 8. The governor may cooperate with any agency or person,public or private, state or federal, and any political subdivision in theadministration of the federal act.

State officers and agencies; cooperation
    
Sec. 9. State officers and agencies shall cooperate with thegovernor, on the governor's request, to further the purposes of thischapter.

Federal funds; application; receipt; disbursement; allocation
    
Sec. 10. The governor may apply for, receive, disburse, andallocate funds that are made available to the state by the federalgovernment.

Contracts to provide services, facilities, studies, and reports
    
Sec. 11. The governor may contract with other agencies, publicand private, that the governor considers necessary to provide the

services, facilities, studies, and reports that will best effectuate thepurposes of the federal act.
