Reinstatement of driving licenses; financial responsibilitycompliance verification fund deposits
Sec. 1. (a) The fee for the reinstatement of a driving license thatwas suspended under IC 9-25 is as follows:
(1) For a first suspension, one hundred fifty dollars ($150).
(2) For a second suspension, two hundred twenty-five dollars($225).
(3) For a third or subsequent suspension, three hundred dollars($300).
(b) The following amount of each fee paid under this section shallbe deposited in the financial responsibility compliance verificationfund established by IC 9-25-9-7:
(1) Of the fee paid for reinstatement after a first suspension, onehundred twenty dollars ($120).
(2) Of the fee paid for reinstatement after a second suspension,one hundred ninety-five dollars ($195).
(3) Of the fee paid for reinstatement after a third or subsequentsuspension, two hundred seventy dollars ($270).
(c) If:
(1) a person's driving license is suspended for registering oroperating a vehicle in violation of IC 9-25-4-1;
(2) the person is required to pay a fee for the reinstatement ofthe person's license under this section; and
(3) the person later establishes that the person did not registeror operate a vehicle in violation of IC 9-25-4-1;
the fee paid by the person under this section shall be refunded.

Petition for waiver of fee for driver's license reinstatement;procedure
Sec. 2. (a) A person who is indigent may file a petition for waiverof a fee for reinstatement of the person's driver's license in a criminalcourt of record in the person's county of residence.
(b) The clerk of the court shall forward a copy of the petition tothe prosecuting attorney of the county and to the bureau. Theprosecuting attorney may appear and be heard on the petition.
(c) The bureau is not a party in a proceeding under this chapter.

Petition for waiver of driver's license reinstatement fee; findingsmade by court
Sec. 3. (a) Upon its own motion, or upon a petition filed by aperson under section 2 of this chapter, a court may waive a fee forreinstatement of a driver's license described in section 1 of this
chapter if the court finds that:
(1) the person who owes the fee for reinstatement of the driver'slicense:
(A) is indigent; and
(B) has presented proof of future financial responsibility;and
(2) waiver of the fee for reinstatement of the driver's license isappropriate in light of the person's character and the nature andcircumstances surrounding the person's license suspension.
(b) If a court waives a fee for reinstatement of a driver's licenseunder this section, the court may impose other reasonable conditionson the person.
(c) If a court waives a fee for reinstatement of a driver's licenseunder this section, the clerk shall forward a copy of the court's orderto the bureau.
