33-10-1. Kinds of courts-martial--Procedures of federal armed forces followed. Except in organizations in the service of the United States, courts-martial in the National Guard are of three kinds: general courts-martial, special courts-martial, and summary courts-martial. Such courts are constituted the same and have cognizance of the same subjects and possess the same powers, except as to punishments, as similar courts provided for by the applicable laws and regulations governing the armed forces of the United States. The proceedings of courts-martial of the National Guard shall follow the forms and modes of procedure prescribed for such similar courts.
