38-14-3. Price differential permitted when necessary to meet nearby competition. Notwithstanding § 38-14-1, when one or more such persons are the only persons engaged in the purchase of grain or flaxseed at a given place in this state, such person or persons may raise prices at that place to, but not above, the prices being paid for the same kind, grade, and quality of grain or flaxseed by a buyer at another place in that immediate section, when necessary to meet actual legitimate competition, without being held to have violated the provisions of this chapter.
