9-38-49. Street improvements by special assessments--Resolution of necessity. Upon recommendation of the board the governing body may provide by resolution of necessity for making improvements upon any road, parkway, boulevard, or street under the control of the board to be paid for by special assessments, which improvements are of such a kind as the governing body is authorized to make on a street under its control and levy special assessments therefor.
