396.526 - Genetics program: Qualifications of personnel; exemption.
1. Â The genetics program must include a geneticist and a cytogeneticist and such other personnel as determined by the Board of Regents and the Health Division of the Department of Health and Human Services.
2. Â Except as otherwise provided in subsection 3:
(a) The clinical services provided by the genetics program must be supervised by a geneticist who is certified or eligible to be certified by the American Board of Medical Genetics and who is a physician licensed in this State.
(b) A cytogeneticist employed by the genetics program must be certified or eligible to be certified by the American Board of Medical Genetics and:
(1) Be a licensed physician; or
(2) Have a degree of doctor of philosophy in a medical or biological science from an accredited college or university and experience in cytogenetics as approved by the University of Nevada School of Medicine.
3. Â The State Board of Health may exempt a geneticist or a cytogeneticist employed by the genetics program from the requirements provided in subsection 2 upon receipt of clear and convincing evidence that hiring a geneticist or a cytogeneticist with qualifications other than those required by subsection 2 substantially complies with the intent of the law and is in the interest of the safety of the public.
