449.781 - Use of forms of restraint by certain facilities.

449.781  Use of forms of restraint by certain facilities.  Notwithstanding the provisions of NRS 449.777 to 449.780, inclusive, to the contrary, a facility may use or authorize the use of physical restraint, mechanical restraint or chemical restraint on a person with a disability who is a patient if the facility is:

1.  Accredited by a nationally recognized accreditation association or agency; or

2.  Certified for participation in the Medicaid or Medicare program,

Ê only to the extent that the accreditation or certification allows the use of such restraint.
