710.147 - Governing body of county whose population is 50,000 or more: Sale of telecommunication service to general public prohibited; exception; conditions for purchase or construction of facilities
1. Â The governing body of a county whose population is 50,000 or more:
(a) Shall not sell telecommunication service to the general public.
(b) May purchase or construct facilities for providing telecommunication that intersect with public rights-of-way if the governing body:
(1) Conducts a study to evaluate the costs and benefits associated with purchasing or constructing the facilities; and
(2) Determines from the results of the study that the purchase or construction is in the interest of the general public.
2. Â Any information relating to the study conducted pursuant to subsection 1 must be maintained by the county clerk and made available for public inspection during the business hours of the office of the county clerk.
3. Â Notwithstanding the provisions of paragraph (a) of subsection 1, an airport may sell telecommunication service to the general public.
4. Â As used in this section:
(a) “Telecommunication” has the meaning ascribed to it in NRS 704.025.
(b) “Telecommunication service” has the meaning ascribed to it in NRS 704.028.
