§ 8103. Remedies cumulative. Remedies provided by this part are cumulative and do not affect the availability of remedies under other law. The procedures established by Pa.R.C.P. No. 1910.1 et seq. (relating to action for support) shall be used in preference to the procedures of this part unless any of the following applies: (1) The tribunal or domestic relations section determines that use of this part is necessary for the effective establishment or enforcement of support because any of the following apply: (i) After diligent effort, the obligee is unable to effect service upon the obligor. (ii) It is not possible to enter an order against the obligor in the county where the obligee resides. (iii) The obligor is already subject to an order for support in the case at bar or in any other case. (2) The obligee requests proceedings under this part.
