§ 6112. Penalties. (a) Criminal penalties.--A person who violates any provision of this chapter or any rule, regulation, standard or order made under this chapter commits a summary offense for the first or second offense. A person who violates any provision of this chapter or any rule, regulation, standard or order made under this chapter commits a misdemeanor of the third degree if the violation is a third or subsequent offense and if the violation occurs within two years of the date of the last previous offense. (b) Civil penalties.--In addition to proceeding under any other remedy available at law or in equity for a violation of this chapter or a regulation promulgated under this chapter, the secretary may assess a civil penalty not to exceed $10,000 upon a person who knowingly and intentionally violates section 6104 (relating to license), 6105 (relating to registration), 6107 (relating to requirements and grades), 6108 (relating to prohibited acts), 6109 (relating to labeling of maple products), 6110 (relating to detained food) or 6111 (relating to manufacturing and marketing practices) or any regulation or order promulgated pursuant to those sections.
