§ 8140. Conditional temporary licenses. When an EMS agency or an applicant for a license to operate as an EMS agency does not provide service 24 hours per day and seven days per week or is unable to participate in a county- level or broader-level emergency medical response plan approved by the department, the department shall issue a conditional temporary license for operation of the EMS agency when the department determines that it is in the public interest, subject to such terms as the department deems appropriate. A conditional temporary license shall be valid for one year and may be renewed as many times as the department determines that it is in the public interest to do so. Effective Date. Section 9(1) of Act 37 of 2009 provided that section 8140 shall take effect 180 days after the publication of the notice in section 7.
