§ 10.1-210. Additional powers of the Department.

In addition to other powers conferred by law and subject to the provisions ofthis article, the Department shall have the power, which may be delegated bythe Director:

1. To establish criteria for the selection, registration and dedication ofnatural areas and natural area preserves.

2. To purchase, lease or otherwise acquire in the name of the Commonwealth,using moneys from the Natural Area Preservation Fund, lands suitable fornatural area preserves.

3. To acquire by gift, devise, purchase, or otherwise, absolutely or intrust, and to hold and, unless otherwise restricted by the terms of a gift ordevise, to encumber, convey or otherwise dispose of, any real property, anyestate or interests therein, or products on or derived from such realproperty, as may be necessary and proper in carrying into effect theprovisions of this article.

4. To accept, hold and administer gifts and bequests of money, securities, orother property, absolutely or in trust, made for purposes of this article.Unless otherwise restricted by the terms of the gift or bequest, theDepartment may sell, exchange or otherwise dispose of such money, securitiesor other property given or bequeathed to the Department. The principal ofsuch funds, together with the income and all revenues derived therefrom,shall be placed in the Natural Area Preservation Fund.
