§ 10.1-2205. Board shall promulgate regulations; penalty.

The Board shall promulgate regulations necessary to carry out its powers andduties, including at a minimum criteria and procedures for the designation ofhistoric landmarks, including buildings, structures, districts, objects, andsites. Such regulations shall be not inconsistent with the National HistoricPreservation Act (P.L. 89-665) and its attendant regulations. The regulationsof the Board shall be promulgated in accordance with the VirginiaAdministrative Process Act (§ 2.2-4000 et seq.).

Any person who violates any regulation adopted pursuant to this section shallbe subject to a civil penalty not to exceed $500. Any civil penalty collectedpursuant to this section shall be deposited into the state treasury.
