§ 15.2-749. Certain referenda in certain counties.

If on or before July 15 of any year in which such referendum is provided forby law a petition signed by 200 or more qualified voters of the county isfiled with the circuit court of the county asking that a referendum be heldon any question upon which a referendum is provided for by any applicablestatute, then such court shall on or before August 1 of such year issue andenter of record an order requiring the county election officials to open thepolls at the regular election to be held in November of such year on thequestion stated in such statute. If the statute providing for such referendumshall authorize or require the referendum to be held at a special election,then the petition hereinabove referred to shall be signed by 1,000 or morevoters of the county and the court shall within fifteen days of the date suchpetition is filed enter an order requiring the election officials to open thepolls and take the sense of the voters of the county on a date fixed in hisorder, which shall be in accordance with § 24.2-682. The clerk of the countyshall cause a notice of such election to be published in a newspaperpublished or having general circulation in the county once a week for threesuccessive weeks, and shall post a copy of the notice at the door of thecounty courthouse.
