§ 17.1-602. When successful plaintiff not to recover costs.

In any personal action not on contract, if a verdict is returned for theplaintiff, on an issue or otherwise, for less damages than ten dollars, heshall not recover in respect to such verdict any costs, unless the courtenter of record that the object of the action was to try a right, besides themere right to recover damages for the trespass or grievance in respect towhich the action was brought, or that the trespass or grievance was willfulor malicious.
