§ 18.2-320. Sale, etc., of plastic bags; warning required.

(a) No person shall sell, offer for sale, or deliver, or offer for delivery,or give away any plastic bag or partial plastic bag intended to enclosefreshly cleaned clothing, the length of which totals twenty-five inches ormore and the material of which is less than one mil (1/1000 inch) inthickness; unless such plastic bag bears the following warning statement, ora warning statement which the Commissioner of Health has approved as theequivalent thereof:

"WARNING: To avoid danger of suffocation, keep this plastic bag away frombabies and children. Do not use this bag in cribs, beds, carriages orplaypens."

(b) Such warning statement shall be imprinted in a prominent place on theplastic bag or shall appear on a label securely attached to the bag in aprominent place, and shall be printed in legible type of at least thirty-sixpoint type.

(c) Violators of this section shall be guilty of a Class 3 misdemeanor.
