§ 2.2-4313. Petition for recycled goods and products; periodic review ofprocurement standards.

A. Any person who believes that particular goods or products with recycledcontent are functionally equivalent to the same goods or products producedfrom virgin materials may petition the Department of General Services orother appropriate agency of the Commonwealth to include the recycled goods orproducts in its procurement process. The petitioner shall submit, prior to orduring the procurement process, documentation that establishes that the goodsor products (i) contain recycled content and (ii) can meet the performancestandards set forth in the applicable specifications. If the Department ofGeneral Services or other agency of the Commonwealth that receives thepetition determines that the documentation demonstrates that the goods orproducts with recycled content will meet the performance standards set forthin the applicable specifications, it shall incorporate the goods or productsinto its procurement process.

B. The Department of General Services and all agencies of the Commonwealthshall review and revise their procurement procedures and specifications on acontinuing basis to encourage the use of goods and products with recycledcontent and shall, in developing new procedures and specifications, encouragethe use of goods and products with recycled content.
