§ 2.2-4318. Negotiation with lowest responsible bidder.

Unless canceled or rejected, a responsive bid from the lowest responsiblebidder shall be accepted as submitted, except that if the bid from the lowestresponsible bidder exceeds available funds, the public body may negotiatewith the apparent low bidder to obtain a contract price within availablefunds. However, the negotiation may be undertaken only under conditions andprocedures described in writing and approved by the public body prior toissuance of the Invitation to Bid and summarized therein.
