§ 2.2-5502. Exemptions from chapter to be determined by Department.

A. The Department may waive part or all of the requirements under thischapter for a specified regulated introduction if the Department determinesthat the satisfaction of that requirement is not necessary to protect thepublic health or the environment.

B. The Department may exempt a class of regulated introductions from part orall of any requirement under this chapter if the Department determines thatthe satisfaction of those requirements or part thereof is not necessary toprotect the public health or the environment.

C. Planned regulated introductions approved by a federal regulator pursuantto the federal Coordinated Framework prior to enactment of this chapter shallbe exempt from the provisions of this chapter.
