§ 20-146.33. Costs, fees, and expenses.

A. The court shall award the prevailing party, including a state, necessaryand reasonable expenses incurred by or on behalf of the party, includingcosts, communication expenses, attorney's fees, investigative fees, expensesfor witnesses, travel expenses, and child care during the course of theproceedings, unless the party from whom fees or expenses are soughtestablishes that the award would be clearly inappropriate.

B. The court may not assess fees, costs, or expenses against a state unlessauthorized by law other than this act.
